Terms and Conditions of Use & Sale
Terms governing platform usage, intellectual property rights, and the purchase of AI creation credits.
1. Subject and Acceptance of Terms
PlayAIStory provides a creative web studio and interactive platform for designing, customizing, and playing branching interactive stories and visual novels powered by generative AI. Registering or using the platform implies full and unconditional acceptance of these Terms and Conditions.
2. Creation Credits System
Generating assets and interactive stories utilizes a prepaid creation credit system. Each successful generation consumes the number of credits displayed in the UI prior to generation. Credits purchased in any pack do not expire while the account remains active. If a generation fails due to an unexpected technical error, the system automatically refunds the credit back to your balance.
3. Pricing and Billing Terms (Merchant of Record)
Credit pack prices are displayed in Euros (€) inclusive of VAT and applicable taxes specified at checkout. Commercial transactions are fulfilled through Polar.sh, who acts as the Merchant of Record, assuming legal and financial responsibility for payment processing, statutory invoice issuance, and tax remittance for applicable jurisdictions.
4. Delivery & Immediate Availability of Digital Services
Purchased credits and digital studio features are intangible digital services. Delivery and balance activation are 100% digital, electronic, and immediate upon successful payment confirmation by the payment gateway.
5. Right of Withdrawal, Refunds, and Cancellations
Pursuant to EU Directive 2011/83/EU on Consumer Rights and statutory regulations: • Statutory Right of Withdrawal: You have the right to withdraw from a credit pack purchase within 14 calendar days from the purchase date without giving any reason, provided the purchased credit pack remains completely intact and unconsumed. • Digital Execution Exception: In accordance with statutory consumer protections for digital content (Art. 103.m LGDCU), the right of withdrawal immediately and expressly lapses once computational AI generation execution has commenced at the user's explicit request (consumed credits). To request a refund for an unconsumed credit balance or resolve a billing issue, please contact customer support at support@playaistory.com with your account email and transaction ID.
6. Intellectual Property, Licenses & AI-Generated Content
• User Original Storylines and Scripts: You retain full ownership and copyright of all original text, storylines, decision branches, dialogues, and titles you create on the platform. • AI Generation License: PlayAIStory does not claim exclusive ownership over raw visual assets produced by underlying AI models. We grant you a perpetual, worldwide, transferable, royalty-free license to use, reproduce, modify, display, and commercially exploit the illustrations and assets generated with your credits in any format or medium (including commercial publications, games, and merchandise). • Platform Operational License: You grant PlayAIStory only a technical, non-exclusive, worldwide, royalty-free license to host, cache, process, and display your stories and assets solely for the purpose of operating the service and displaying them publicly in the community if you explicitly choose to publish them.
7. Uploaded Photographs, Likeness & Third-Party Consent
The platform allows users to upload personal photographs as visual references to transform real memories into illustrated characters. When using this feature: • Warranty of Rights & Express Consent: You represent and warrant that you hold all necessary legal rights to uploaded images or have obtained the prior, informed, and express consent of every recognizable individual appearing in the photographs. • Strict Prohibition on Non-Consensual Likeness and Minors: You may not upload photographs of third parties without their express consent, images of public figures for defamatory purposes, or photographs of minors unless you are their parent or statutory legal guardian. • Indemnification: You agree to indemnify, defend, and hold harmless PlayAIStory and its operator against any third-party claims, regulatory penalties, or liabilities arising from a breach of personal privacy, likeness, or publicity rights resulting from images you upload.
8. Acceptable Use Policy and Prohibited Content
You may not use the service to generate, host, or disseminate: • Child Sexual Abuse Material (CSAM) or any form of child exploitation under a strict zero-tolerance policy and immediate reporting to law enforcement authorities. • Content inciting violence, illegal acts, or discrimination based on race, religion, gender, or sexual orientation. • Materials infringing upon third-party copyrights, trademarks, trade secrets, or proprietary rights. • Malicious exploitation, reverse engineering, decompilation, vulnerability probing, or unauthorized automated scraping of the platform.
9. Copyright Infringement & Notice-and-Takedown (EU DSA / DMCA)
Pursuant to the EU Digital Services Act (Regulation 2022/2065 - DSA) and intermediary liability frameworks, PlayAIStory operates as a technical hosting provider: • Safe Harbor & Intermediary Status: PlayAIStory does not exercise general prior editorial control over user-published community content. • Notice-and-Takedown Procedure: If you believe content hosted on PlayAIStory infringes your copyright, trademark, or likeness rights, please submit a formal notice to legal@playaistory.com including: (1) Identification of the protected work or right claimed to be infringed; (2) The exact URL or location of the infringing content; (3) Your contact information and evidence of authorization. Upon receipt of a valid notice, PlayAIStory will act expeditiously to remove or disable access to the infringing material.
